Information Collection

Ownership Juice Wireless, Inc. is the sole owner of the information collected on the Mobile Birthday Reminder ("MBR") service.

Registration In order to use MBR service, a user must first complete the registration form. During registration, a user is required to give contact information (including name, mobile phone number, wireless carrier and email address) and other information. We use this information to contact the user about services on our MBR service for which he/she has expressed interest. We also require a user's mobile telephone number in order to provide the services requested by the user.

Subscription / Registration We request information from the user on our subscription and/or registration form. A user must provide contact information (such as name and address) and may be asked to provide certain financial information (such as credit card number and expiration date). This information is used for billing purposes and to fill customer's orders. If we have trouble processing an order, the information is used to contact the user.

Information Use

Profile We store information that we collect through cookies, log files and clear gifs, to create a profile of our users. A profile is stored information that we keep on individual users that details their viewing and usage preferences. Consequently, collected information is tied to the user's personally identifiable information to provide offers and improve the content of MBR for the user. This profile is used to tailor a user's visit to www.mobilebday.com or directly on the user's mobile phone. Your profile will be shared in aggregate form only.

Cookies "Cookies" are pieces of information that are placed on an individual's computer hard drive to enable the individual to more easily communicate and interact with a website. MBR uses cookies to customize your experience and usage of the MBR service. We use cookies to deliver content specific to your interests, to save your password so you will not have to re-enter it every time you visit the MBR service on the Internet or your mobile phone, and for other purposes. You may, however, disallow receiving cookies at any time through your web browser, although some portions of MBR may not function properly if cookies are disallowed. The MBR service will never use cookies to retrieve information from a computer that is unrelated to MBR or your interaction with the MBR service.

Some of our business partners may use cookies on MBR. However, we have no access to or control over these cookies once we have given permission for them to set cookies for advertising.

This privacy statement covers the use of cookies by MBR only and does not cover the use of cookies by any third parties.

Log Files Like most standard Internet services we use log files. This includes internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer MBR, track user's movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses, etc. are not linked to personally identifiable information.

Communication from the Site

Special Offers and Updates We send all new members a welcoming text message and/or email to verify their mobile phone and other information. Established members will occasionally receive information on products, services, special deals, and a newsletter through both their email address and/or their mobile phone via SMS. Out of respect for the privacy of our users we present the option to not receive these types of communications. Please see the Choice and Opt-out sections.

Service Announcements On rare occasions it is necessary to send out a strictly service-related announcement. For instance, if our service is temporarily suspended for maintenance we might send users an email or SMS message. Generally, users may not opt-out of these communications, though they can deactivate their account. However, these communications are not promotional in nature.

Customer Service We communicate with users on a regular basis to provide requested services and in regards to issues relating to their account we reply via email, phone, or text message, in accordance with the users' wishes.

Sharing Legal Disclaimer Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on MBR or its owners.

Aggregate Information (non-personally identifiable) We share aggregated demographic information with our partners and other third parties. This is not linked to any personally identifiable information.

These are the instances in which we will share users' personal information:

Third Party Intermediaries We use a credit card processing company and/or mobile service provider to bill users for goods and services. These companies do not retain, share, store or use personally identifiable information for any secondary purposes.

Business Transactions In the event MBR or its owners goes through a business transition, such as a merger, being acquired by another company, or selling a portion of its assets, users' personal information will, in most instances, be part of the assets transferred. MBR users will be notified via email, SMS message or prominent notice on our website at www.mobilebday.com for 7 days prior to a change of ownership or control of their personal information. If as a result of the business transition, the users' personally identifiable information will be used in a manner different from that stated at the time of collection they will be given choice consistent with our notification of changes section.

Choice/Opt-out Our subscribers and/or users are given the opportunity to 'opt-out' of having their information shared with third parties or used for purposes not directly related to MBR or described in the Terms of Use of the MBR service (see www.mobilebday.com /termsandconditions/html). For example, our registration form has an "opt-out" mechanism so users who register for MBR, but do not want any email based marketing material, can keep their email address off of our lists.

Users who no longer wish to receive our newsletter and promotional communications may opt-out of receiving these communications by changing their settings on the "My Account" page.

Links MBR may contain links to other websites. Please be aware that we are not responsible for the privacy practices of such other websites and/or mobile phone services. We encourage our users to be aware when they leave our service and to read the privacy statements of each and every website and/or mobile phone service that collects personally identifiable information. This privacy statement applies solely to information collected by MBR.

Security We take security very seriously. We attempt to provide for the secure transmission of your information from your computer to our servers by utilizing state of the art encryption software. However, due to the open communication nature of the Internet specifically, we cannot guarantee that communications between you and the MBR service, you and our website and you and our mobile phone based communications will be free from unauthorized access by third parties. Users of MBR do so at their own risk. To prevent unauthorized access and maintain accuracy, MBR has in place appropriate physical, electronic and managerial procedures to secure the information we collect on MBR. Employees with access to personally-identifiable information are required to follow our security rules, which state that such information must be used only for the purpose of providing the MBR service to you. These information access controls are regularly reviewed and updated.

Correcting/Updating/Deleting/Deactivating Personal Information If a user's personally identifiable information changes (such as zip code, phone, email or postal address), or if a user no longer desires our service, we provide a way to correct, update or delete/deactivate users' personally identifiable information. This can usually be done at the "My Account" page or by emailing our Customer Support at support@mobilebday.com.

Notification of Changes If we decide to change our privacy policy, we will post those changes to this privacy statement, the homepage, and other places we deem appropriate so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We will use information in accordance with the privacy policy under which the information was collected.

If, however, we are going to use users' personally identifiable information in a manner different from that stated at the time of collection we will notify users via email. Users will have a choice as to whether or not we use their information in this different manner. However, if users have opted out of all such communication with MBR, or deleted or deactivated their account, then they will not be contacted, nor will their personal information be used in this new manner. In addition, if we make any material changes in our privacy practices that do not affect user information already stored in our database, we will post a prominent notice on MBR notifying users of the change. In some cases where we post a notice we will also email or SMS users who have opted to receive communications from us notifying them of the changes in our privacy practices.

Your Acceptance of this Policy By visiting the Site, you signify your assent to the terms of this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not use the MBR service. We reserve the right, at our discretion, to change, modify, add, or remove portions from this Privacy Policy at any time. Your continued use of MBR following the posting of changes to these terms means you accept these changes.
